Welcome to nfty. We are committed to protecting your privacy and ensuring the security of your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit nfty.us, contact us, or use NFTY-hosted platform applications and related services (collectively, the "Services").

This is an umbrella platform policy. Certain white-label or product-specific applications (for example, a branded social club or client-operated site) may publish additional privacy notices that apply alongside this policy.

By accessing or using the Services, you acknowledge this Privacy Policy. If you do not agree, please do not use the Services. For questions, please contact us.

2. Scope of This Policy

This policy covers the NFTY marketing website and NFTY-hosted applications and product categories, including but not limited to:

  • Powerless POS (QR/NFC checkout for parking, events, valet, food trucks, and pop-ups)
  • HIPAA-oriented healthcare AI and document workflows (where a BAA applies)
  • Social club platforms (membership, events, messaging, coach scheduling)
  • Restaurant ordering, loyalty, and valet integration
  • Scheduling and booking platforms
  • Referral programs and dashboards
  • Document management and signing workflows
  • Tutoring / learning platforms
  • Field-service booking and related admin, billing, authentication, and support tools

Product-specific apps may maintain their own privacy policies for member or customer relationships that go beyond this platform notice.

3. Information We Collect

Account and contact information. Name, email address, phone number, username, and similar identifiers when you register, sign in, or contact us.

Business and organization information. Company name, role, venue or property details, and other information you provide about your business or organization.

Payment information. Payment card or bank details are collected and processed by third-party payment processors. See Section 6.

Location, QR, and NFC context. Approximate or precise location and scan context when you use Powerless POS, check-in, or other location-aware features.

Transactional and operational data. Orders, bookings, memberships, referrals, schedules, loyalty activity, and related history.

Communications and content. Messages, support requests, uploaded documents, images, and other content you submit through the Services.

Device, log, and usage data. IP address, browser and device type, pages viewed, app usage patterns, referrers, and diagnostic logs.

Cookies and similar technologies. Session, preference, and analytics cookies or similar identifiers. See Section 9.

4. How We Use Information

We use information to:

  • Provide, operate, and improve the Services
  • Authenticate users and manage accounts
  • Process payments and prevent fraud
  • Fulfill bookings, orders, memberships, and referrals
  • Provide customer support and respond to inquiries
  • Maintain security, monitor abuse, and troubleshoot issues
  • Analyze usage to improve performance and product design
  • Send service-related notices (for example, account or booking confirmations)
  • Send marketing communications where permitted โ€” you may opt out of marketing at any time

We do not sell personal information.

6. Payments

Payment card and bank account information is handled by PCI-compliant third-party processors (such as Stripe). NFTY does not store full payment card numbers on its servers. Your use of a payment processor is also subject to that processor's privacy policy and terms.

7. Location, QR & NFC

When you scan a QR code or NFC tag, or use a location-aware feature, we may collect location or context data needed to show the right menu, stall, check-in, or booking experience. You can control precise location access through your device settings where applicable. Disabling location may limit some features.

8. HIPAA & Regulated Data

Where NFTY develops or operates software that handles Protected Health Information ("PHI") as defined under HIPAA, the parties will execute a separate Business Associate Agreement ("BAA") before PHI is processed. In those engagements, NFTY implements additional administrative, physical, and technical safeguards required by the BAA and applicable law. You are responsible for ensuring your use of such software complies with regulations governing your industry.

9. Cookies & Similar Technologies

We use cookies and similar technologies to keep you signed in, remember preferences, measure performance, and understand how the Services are used. You can control cookies through your browser settings. Blocking cookies may affect login, checkout, or other features.

10. Data Retention

We retain personal information for as long as needed to provide the Services, meet legal and accounting obligations, resolve disputes, enforce agreements, and maintain security. Retention periods vary by data type and product context.

11. Security

We implement commercially reasonable security measures, including TLS/SSL encryption in transit, encryption at rest where applicable, access controls, and audit logging. No method of transmission or storage is 100% secure. We will notify affected parties of certain security incidents as required by applicable law.

12. Your Rights & Choices

Depending on your location and applicable law, you may have rights to access, correct, or delete personal information, or to object to or restrict certain processing. You may also opt out of marketing emails using the unsubscribe link or by contacting us.

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will take reasonable steps to delete it. Tutoring or family products used by adults on behalf of minors are governed by the applicable product terms and any additional notices for that product.

14. Third-Party Links & Product-Specific Policies

The Services may link to third-party websites, payment processors, maps, messaging providers, or other tools. Their privacy practices are governed by their own policies. White-label or product-specific NFTY apps may also publish additional privacy notices; those notices control for conflicts on product-specific topics to the extent stated in those notices.

15. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page with an updated "Last Updated" date. Continued use of the Services after changes become effective constitutes acceptance of the updated policy.

16. SMS / Text Messaging

If you opt in to SMS from NFTY (including via nfty.us/sms-opt-in), we may send account notices, service updates, and related offers. Message frequency may vary. Standard Message and Data Rates may apply. Reply STOP to opt out. Reply HELP for help.

Your mobile information will not be sold or shared with third parties for promotional or marketing purposes.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties for purposes unrelated to providing you with the messaging service. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and other vendors who assist us in the delivery of text messages.
